Vacation time.

I'm off for a long week of doing as little as possible down on Hilton Head Island. Won't have my computer with me, so no chance of anything from me here until a week from Sunday at the very earliest.

And never forget that you're the hero, apostropher. I'm sure you can figure out a way to blog without a computer. I've heard that George Washington did it once.

Not really. I doubt your page is registered, so no Federal statutory protection. You could claim a common law copyright, but then you'd have to prove you have a prior proprietary interest in "parking your scooter," as depicted.

You misunderstand copyright law, shpx. First, the concept of "common law copyright" is entirely irrelevant here. Common law copyright is an obsolete legal doctrine that US courts rejected decades ago. And even so, your contention that "you'd have to prove you have a prior proprietary interest in 'parking your scooter'" is simply bizarre. Copyright protects specific creative works, not general ideas and concepts.

Moving right along to the law that actually matters, the U.S. Copyright Office website tells us:

The way in which copyright protection is secured is frequently misunderstood. No publication or registration or other action in the Copyright Office is required to secure copyright... Copyright is secured automatically when the work is created, and a work is "created" when it is fixed in a copy or phonorecord for the first time.

Then, on the "Copyright Registration" section, we find this:

Before an infringement suit may be filed in court, registration is necessary for works of U. S. origin.

The blog post in question, the photo, and the design of my blog in general, are not works of U.S. origin, since I am based in Japan. My thuggish, belligerent lawyers will be in touch presently.
